By accessing the houston-waterdamage.com website or engaging Restorative Cleaning Solutions ("we", "us", "our", "Company") for restoration services, you ("you", "Customer", "you") agree to be bound by these Terms of Service. If you do not agree, do not use the site or our services.
Restorative Cleaning Solutions provides water damage restoration, flood damage restoration, mold remediation, fire and smoke restoration, sewage cleanup, content cleaning, and structural drying services in the greater Houston, Texas metropolitan area. All services are performed per the Institute of Inspection, Cleaning and Restoration Certification (IICRC) standards and Texas Department of Licensing and Regulation (TDLR) requirements where applicable.
Project scope is documented in writing before work begins. Insurance-billed projects use Xactimate scope of loss. Customer-paid projects use a written estimate. Change orders for scope expansion are documented and authorized in writing. Verbal-only changes are not binding.
When you engage us to bill your insurance carrier directly, you authorize us to communicate with your carrier, your adjuster, and your mortgage company (if applicable) about your loss. You agree to assign payment from insurance directly to Restorative Cleaning Solutions where allowed, or to pay over insurance proceeds upon receipt.
Our maximum liability for any claim arising from services provided is limited to the amount paid by you (or by your insurance) for the specific service giving rise to the claim. We are not liable for consequential, indirect, or punitive damages, including loss of business, loss of use, or emotional distress.
Cancellation prior to mobilization: no charge. Cancellation after mobilization but before work begins: $250 mobilization fee. Cancellation after work begins: customer pays for work completed plus restocking on returned materials.
Any dispute arising from these Terms or services provided shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Texas law governs. Venue is Harris County, Texas.
We are not liable for delays or failures caused by events beyond our reasonable control: hurricanes, floods, government orders, labor strikes, supply chain disruptions, pandemics, or acts of war. During declared emergencies, we operate under triage protocols communicated in writing.
All website content, including text, images, logos, and design, is the property of Restorative Cleaning Solutions or its licensors and is protected by copyright. You may not reproduce, distribute, or create derivative works without written permission.
We reserve the right to modify these Terms at any time. Continued use of our services after modifications constitutes acceptance. We will notify customers of material changes via email or at the next service interaction.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
